Privacy Notice

This English translation is provided for convenience only. In case of any discrepancy, the Spanish version prevails.
In accordance with Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties, published in the Official Gazette on March 20, 2025 (the "Law"), this notice explains how we process your personal data.
1. Data controller
Alejandro Molina Pantoja, an individual engaged in business activities under the trade name LEXATEK ("LEXATEK"), domiciled in Córdoba, Veracruz, México, is responsible for processing your personal data.

2. Personal data we process
a) On this website
- Contact form: name, email address, phone or WhatsApp number, preferred contact method, company or business, current website, service of interest and the message you write to us.
- Technical data: IP address and date and time of submission, used for security and to prevent automated messages (spam).
- Browsing data, only if you accept analytics cookies: cookie identifiers, pages visited, device and browser type, and approximate location (city or region). See the Cookie Policy.
b) In client relationships
If you hire our services, we may also process: name or company name, tax ID (RFC), tax address, contact details of the people involved in the project, and the data needed to invoice and reconcile payments. Payment data is financial data; we only collect it with your express consent.
We do not process sensitive personal data. Please do not include it in your messages.
c) Data our clients are responsible for
When we build, host or maintain our clients’ websites and systems, we may have access to personal data for which they are responsible (for example, messages received through their forms). In those cases LEXATEK acts as a processor: it processes that data only to provide the service, following the client’s instructions, and does not use it for its own purposes. This notice does not replace each client’s own privacy notice.
3. Purposes
Purposes necessary to handle your request or client relationship
- Answer your information and quote requests through the channel you choose.
- Prepare proposals and follow up on the engagement.
- Provide the contracted services (design and development, hosting, maintenance, support and others).
- Invoice, collect payments and comply with tax and legal obligations.
- Protect the security of the website and prevent abuse of the form.
Purposes that require your consent
- Send you information about our services. We will only do so if you check the corresponding box on the form or authorize it by other means.
- Measure website usage with Google Analytics to improve it. It only runs if you accept analytics cookies.
Declining these purposes does not affect how we handle your request. You may withdraw your consent at any time (section 7).
4. Service providers processing data on behalf of LEXATEK
To operate the website and our communications we use providers that process data solely on behalf of LEXATEK and according to our instructions (processors, under the Law). Some have servers outside Mexico:
- Google (Google Workspace): the email service where we receive your messages.
- Google (Google Analytics): website usage statistics, only with your consent.
- Cloudflare (DNS and Turnstile): domain resolution and verification that the form is submitted by a person and not an automated program.
- HostArmada: website hosting.
If you choose to contact us via WhatsApp, that communication is also governed by WhatsApp’s terms and privacy policy.
5. Transfers
LEXATEK does not sell your personal data or transfer it to third parties for their own use. We may only transfer it without your consent in the cases permitted by Article 36 of the Law; for example, when required by law or a competent authority, or when necessary to perform our legal relationship with you (such as registering a domain in your name). If any other transfer becomes necessary, we will ask for your consent first.
6. ARCO rights
You have the right to Access your data, Rectify it if inaccurate, Cancel it and Object to its processing. To exercise these rights, send a request to contacto@lexatek.mx including:
- Your name and how you want to receive the response.
- A document proving your identity (such as a voter ID or passport) and, if acting on behalf of another person, proof of representation.
- A clear description of the data and the right you wish to exercise.
- Any other information that helps locate your data.
We will respond within 20 days of receiving your request. If it is granted, we will carry it out within 15 days after our response. These periods may be extended once, for an equal period, when justified, and we will inform you.
If you believe your request was not handled in accordance with the Law, you may contact the Secretaría Anticorrupción y Buen Gobierno, the authority responsible for enforcing the Law.
7. Withdrawal of consent and limiting use
- You may withdraw your consent at any time, without retroactive effect, by writing to contacto@lexatek.mx. If withdrawal prevents us from handling a pending request, we will let you know.
- To stop receiving information about our services, write to the same address or reply to any of our emails asking to unsubscribe.
- To disable Google Analytics, change your choice using the "Cookie settings" link in the footer or delete the cookies in your browser.
8. Retention and security
We keep your data only as long as needed for the purposes of this notice and to comply with legal and tax obligations; it is then deleted. We apply administrative, technical and physical security measures to protect your data against damage, loss, alteration, destruction or unauthorized use, access or processing.
9. Changes to this notice
Any changes will be published on this page with the date of the latest update. If a change affects purposes that require your consent, we will ask for it again.
